1. General information

1.1 Die Betreiberin von supersilk.ch ist die SUPERSILK AG (nachfolgend „SUPERSILK STUDIO“ genannt) mit Sitz in Zug.

1.2 The following "General Terms and Conditions (GTC)", in the version current at the time of purchase, shall apply exclusively to the business relationship/contract conclusion between SUPERSILK STUDIO and the customer. Changes or additions are marked by the date of the last update (see above).

1.3 All deliveries, services and offers on www.supersilk.ch are based exclusively on these General Terms and Conditions. Contradictory or deviating from the applicable terms and conditions on the part of the customer Supersilk Studio not recognize, unless Supersilk Studio would have expressly agreed to their validity. Contractual performance acts on the part of Supersilk Studio, which deviate from the general terms and conditions, are considered as an exception and not as consent for future legal transactions between the contracting parties.

1.4 By ordering by phone or clicking the "Buy" button, the buyer accepts these "General Terms and Conditions (GTC)".

2. Appointment booking

2.1 All agreed appointments (verbally by telephone / in person on site or in writing by e-mail / via booking system) are binding and lead to the conclusion of a contract between Supersilk Studio and you as customer/client.

3. Terminabsagen oder nicht erscheinen eines Termines ohne vorherige Absage

If you do not show up at the agreed time and do not notify us at least 48 hours in advance, we will be forced to charge 100% of the reserved service. You will not be entitled to any compensation. Furthermore, we cannot cover your individual risk of absence due to acute illness or occupational disability.

If you are late for the appointment, you are entitled to a service for the remaining time of the agreed service. Provided that the remaining time is sufficient to provide you with the service qualitatively and satisfactorily. If this is not the case, we reserve the right to charge the full amount for the appointment without providing the service. If an appointment cannot be kept on our part, we are entitled to postpone the appointment at short notice or to withdraw from the contract. We will do everything in our power to inform you immediately, either verbally or in writing.

Should you not be able to attend your personal appointment or should you choose another service of inferior value in terms of time and money, we will take the liberty of charging you for the appointment with the originally booked service.

4. conclusion of contract

4.1 The contractual relationship comes into effect after the customer has placed the order. If any problems arise in connection with your order, we will contact you.

4.2 After payment of the ordered goods or after confirmation of your order, you can no longer change your order. Please make sure that all information is correct before you place the order. We expressly point out that after placing the order changes to the specified delivery address are no longer possible.

4.3 Supersilk Studio reserves the right to refuse orders. In particular, we reserve the right to refuse an order due to a reason listed below, including without limitation in the following cases:

The ordered product is not in stock
We do not receive authorization of your payment
There are errors in the product description, including price or advertising, and/or
We suspect fraudulent transactions

In the event of such a case, we will of course inform you immediately. If the payment has already been made, we will refund the amount within 14 days. Products are sold subject to availability. Due to the time difference between placing and accepting the order, there may be a change in the stock of certain products. If you order a Product that was sold out prior to our acceptance of your order, we will notify you as soon as possible and you will not be charged any purchase price for the sold out Products.

4.4 As far as is within our control, we will take every care to keep the details of your order and payment secure. However, except in the case of negligence by us, we cannot accept any liability for any losses you may suffer as a result of a third party gaining unauthorized access to the details you have provided in the ordering process.

5. Delivery

5.1 Delivery is free of shipping costs from CHF 100.- value of goods (below CHF 100.- CHF 7.- shipping).

5.2 We supply customers exclusively within Switzerland and Liechtenstein.

5.3 Delivery is made within 5 working days after payment, unless otherwise noted in stock or in the product offer.

6. Prices

All prices are in Swiss Francs (CHF), incl. 7.7% VAT.

7. Payment

The ordered goods must be paid by credit card, PayPal, postal or bank transfer. The payment term for ordered goods is 30 days from the date of receipt of the order.

8. Right of withdrawal and return

According to Swiss law, the buyer is not entitled to a general right to cancel his order, i.e. there is no general right to return the goods received.

However, a right of return is granted for the following reasons:

The received goods are damaged or soiled to such an extent that they cannot be used for their purpose (defects).
We did not deliver to the buyer as ordered, i.e. due to an error on our part, a delivery was made with the wrong item or the wrong quantity.
In the case of correctly received delivery, if the buyer has made a mistake in the choice of product, the ordered product can be returned in the unopened original packaging and the correct product can be ordered. A credit in this case can only be granted in the form of a credit for the next order.
If orders are returned to us in opened original packaging, we reserve the right to return them to the customer, charging the postage costs.

If the received goods have defects, the warranty is limited to the return of the goods and refund of the purchase price, provided that the inspection of the ordered goods has taken place within 7 days after receipt. Otherwise Supersilk Studio reserves the right to refuse the return of the goods and thus a refund. If there is a wrong delivery on the part of Supersilk Studio, i.e. the delivery does not correspond to the customer's order, the same conditions apply.

In addition to the refund of the invoice amount for the goods, in these two cases any shipping costs will also be refunded to the buyer. However, these will only be refunded in the form of a voucher.

The Purchaser may also request a replacement delivery instead of a refund of the purchase price. In this case, the shipping costs will also be reimbursed in the form of a voucher.

9. Return of goods

An article return by the customer requires in any case the prior consent of Supersilk Studio and is at the expense and risk of the customer. Sold-out or remaining stock items can generally not be returned.

The return must be made within 10 days from the date of delivery. Return shipping costs are the responsibility of the customer. The goods may only be returned in new, unused original condition, i.e. in the unopened original packaging and in the original shipping packaging. Defective or soiled goods or defective or soiled original packaging will not be refunded. The goods must be professionally packed with all accessories, together with a copy of the invoice, and sent to the following return address:

The purchase price refund (minus the shipping costs incurred / usually CHF 9.-) of the goods according to the original invoice or a replacement delivery will be made within a maximum of 2 weeks after the incoming goods inspection.

10. Damages and liability

Any claims for damages, e.g. due to incorrect illustrations, misrepresentations, incorrect prices or text errors are strictly excluded. Supersilk Studio is in principle not liable for any indirect damages as well as consequential damages arising from the use, by malfunction or failure of performance.
